Uber Said to Have Hired Law Firm to Probe How It Handled Delhi Rape Case

Uber Technologies has hired a law firm to investigate how it obtained the medical records of a Delhi woman executive who was raped by an Uber driver in 2014. The review will focus in part on accusations from some current and former employees that bribes were involved, two people familiar with the matter told Reuters.

The law firm O’Melveny & Myers LLP, which is in the early stages of the probe, was hired by the ride service after employees gave contradictory accounts of how Uber obtained the medical records, one of the people said.

The firm is also exploring whether former Chief Executive Travis Kalanick knew how Uber came into possession of the records, the person added.

Kalanick through a spokesman declined to comment. Uber also declined to comment, and O’Melveny & Myers did not respond to a request for comment. Members of Uber’s board were briefed about the investigation in recent days, shortly before five major Uber investors sent a letter to Kalanick to demand his resignation, said the person. The probe was likely one reason the board turned against Kalanick, who stepped down on Tuesday, the first person said.

The investigation is ongoing and has not reached any conclusions on whether Uber improperly obtained the records. Reuters has no evidence that bribery occurred.

The rape survivor from Delhi sued Uber last week, accusing the ride service operator of improperly obtaining and sharing her medical records. The suit said that shortly after the rape occurred, former Uber Asia chief Eric Alexander “met with Delhi police and intentionally obtained plaintiff’s confidential medical records.”

Alexander, through spokeswoman Heather Wilson, denied paying any bribes and said that the files containing the victim’s records had been obtained through appropriate, legal methods.

A Delhi police spokesman did not answer multiple phone calls from Reuters to seek comment. The rapist was convicted in 2015.

According to a person familiar with conversations between Kalanick and Alexander, the two executives had discussed obtaining the victim’s records because they suspected the rape might have been fabricated by Uber rival Ola to damage the company.

Another person said Alexander showed the medical files to colleagues in New Delhi more than once.

Wilson denied that Alexander had discussed or shared the records with colleagues. She said that Alexander believed the victim was raped and never expressed the view that it was a set up. Uber fired Alexander earlier this month.

Kalanick, 40, announced late on Tuesday that he was resigning as chief executive, though he would remain on the board of Uber. He said he had accepted “the investors’ request to step aside so that Uber can go back to building rather than be distracted with another fight.”

Privately held Uber has grown from startup to a global ride service valued at $68 billion in less than a decade, driven by Kalanick, who set the tone of a company that challenged laws and norms to succeed.

Confidence in Kalanick had been strained this year by claims of sexual harassment in the company and a lawsuit accusing Uber of benefiting from trade secrets stolen from self-driving cartechnology from Alphabet Inc’s Waymo.

How To Stop Your Skin Drying Out On A Flight (And Other Expert Travel Tips)

So you’re going on holiday and you’ve been diligently moisturising your skin for weeks now ahead of its inevitable (but safe, thank you Factor 50) exposure to the sun.

You hop on a flight, hop off the other end… and realise that your skin now resembles sandpaper it’s so dry. That, and you’re sporting a happy cluster of spots on your forehead.

Great.

You’re also exhausted from so little sleep on the flight, and your neck hurts too from the three minutes’ kip you actually did get (when your head momentarily lolled forward at the end of that movie).

In all, not a great way to start a holiday.

But it doesn’t have to be this way. Follow these tips from the experts and your flight dilemmas should soon fly, fly away…

Skin

Dr Sam Bunting, the cosmetic dermatologist who specialises in flawless skin, gives her tips on how to keep your skin hydrated (and spot free) on a flight…

To stop your skin drying out…

Air travel (especially long-haul) wreaks havoc on the skin primarily because of the low humidity of the cabin air, leading to dry, tight skin.

This means it’s incredibly important to carry the right products to combat these issues. I recommend that once on board, you remove your make-up. This ensures that your leave-on products can penetrate and help preserve skin barrier function.

The best type of cleanser is a non-foaming, non-comdeogenic one. A micellar water is really convenient when a proper water-based cleanse is tricky. I like the classic Bioderma Sensibio Micellar Water.

It is helpful to boost your water intake and avoid dehydrators like alcohol and caffeine – but in order to boost skin hydration you must also reduce water loss from the skin by applying moisturiser.

One of my favourites is Obagi Hydrate – truly awesome for surviving flights. I suggest reapplying hourly – check skin regularly and reapply if skin doesn’t feel moist to touch.

To prevent a breakout after a flight…

In addition to the causes referenced above, the stress of air travel, with impaired sleep, poor-quality food and switching time-zones adds to the mix. This can lead to breakouts in the ‘U’ of the face.

If you’re spot-prone take an appropriate anti-blemish treatment containing 2% salicylic acid or 2.5% benzoyl peroxide.

If you’re using a retinoid as part of a blemish-prevention strategy, keep it going if you’re on a night flight.

Lee Mullins, founder of Workshop Gymnasium at the Bulgari Hotel (and trainer to the stars) reveals his tips for sleeping and releasing neck tension…

To get to sleep in economy…

Before you fly, figure out if you sleep on your right or left, then try and pre-select a window seat that matches the side you sleep on.

When on the flight, recline the chair as much as possible, this will help lower pressure on your spine.

Place a rolled-up blanket or your carry-on bag under your feet to help raise your feet and reduce the pressure on your lower back.

If you don’t manage to get to sleep…

I would suggest getting up every 30 – 60 minutes to walk around.*

[*Moving around can decrease your risk of Deep Vein Thrombosis, so it’s important to keep moving!]

To release tension in your neck and shoulders on a flight…

One of the most effective suggestions is to practice diaphragmatic breathing.

You can do this by taking a deep breath through your nose for 4 seconds, so that your tummy expands. Then hold your breath for another 4 seconds, before exhaling through your nose for 4 seconds.

This is a great technique for relaxing the body, decreasing tension in the neck and shoulders and calming the body to make it easier to fall asleep.

Infosys’ Audit Committee Finds No Wrongdoings In Panaya Deal

New Delhi: IT major Infosys today said its internal audit committee has found no evidence supporting a whistleblower’s allegations of improprieties related to the Panaya acquisition. In February, Infosys had said it will investigate claims levelled by the whistleblower in an anonymous mail to market regulator Sebi, alleging wrongdoings by the company when in buying Israeli automation technology firm Panaya.

While strongly refuting the allegations, the Bengaluru-based firm had also hired Gibson Dunn and Control Risks (GDCR) to conduct an internal investigation into the charges.

“Gibson Dunn and Control Risks have now completed their detailed and extensive Independent Investigation and as they have described in the attached document, they did not find any evidence whatsoever of wrongdoing,” Infosys said in a statement.

It added that the company has fully cooperated with all requests for information from Sebi regarding the anonymous complaints.

In February 2015, Infosys had announced buying the Israeli automation technology company for $200 million or Rs. 1,250 crore in cash.

GDCR, in its report, said it had found no evidence to support allegations regarding wrongdoing by the company or its directors and employees.

It added that there were no conflicts of interest or kickbacks and the approvals required for the acquisitions were obtained with regard to the Panaya acquisition.

“…thorough due diligence was conducted, the valuations of the target companies done by an outside financial advisor were reasonable, and the purchase prices were within the range of values determined by that advisor,” it said.

Also, it said it had found no evidence that CEO Vishal Sikka had received excessive variable compensation or incurred unreasonable expenses for security, travel and the Palo Alto office.

Ford Announces Recall For Over 39,000 Cars In India

Ford India has issued a recall of over 39,315 units of its cars produced from 2004 to 2012. The models affected are the Ford Fiesta Classic and the first generation of the Figo hatchback. The cars in question were made at the Ford India manufacturing facility in Chennai between the years 2004 and 2012. The reason for the recall is the potential concern related to the high pressure power assisted steering (or PAS) hose. Ford South Africa has also issued a similar recall due to the same fault.

The cars affected in that market are the Ikon and Figo, that were also made in the same duration in India, and exported to South Africa. Ford says a power steering fluid leak could result in fumes being emitted from the engine compartment. It is then possible the  power steering fluid to come into contact with the vehicle’s exhaust system components, and then cause either smoke or in very few cases – a possible fire.

The Ford Fiesta Classic was built at the company’s Chennai plant

Ford India says this is a voluntary inspection it will carry out, and in a statement issued to us, has also said, “Ford India, through its dealers, will replace the high pressure power assisted steering hose on all affected vehicles. Ford remains committed to delivering world-class quality vehicles to its customers and this voluntary safety recall is part of that commitment.”

The Figo remains the company’s best selling hatchback in India

Like it is the case of all recalls, the move is a preemptive one, and seeks to correct a potentially hazardous scenario. Owners of said affected vehicles will be contacted by Ford dealers/ company officials directly.

Maruti Suzuki Dzire Bookings Cross 51,000 Mark

The Maruti Suzuki Dzire has reached a new milestone with the company receiving over 51,000 bookings for the car. It’s been just a little over a month since the car has been launched in India and such impressive numbers show us that the Dzire might continue to be the undisputed leader of the subcompact sedan space. In fact, Maruti Suzuki India received over 44,000 bookings for the new Dzire in just about two weeks, which itself is quite an impressive feat considering the price of the car has also gone up.

Launched at ₹ 5.45 lakh to ₹ 9.41 lakh (ex-showroom, Delhi), the new Maruti Suzuki Dzire comes with a bit of a premium quotient both in terms of styling and features. In fact, the new Dzire is almost a new car in some aspects. Thanks to the company’s all-new HEARTECT platform, the new Dzire has been able to shed about 105 kg compared to its predecessor and at the same time, it has also become more rigid. The car has also received some dimensional changes as the new Dzire is 40 mm wider and comes with a 20 mm longer wheelbase. What this means is the cabin is now a bit roomier and more comfortable, which we have addressed in our review.

new maruti suzuki dzire
The feature list is also equally impressive, with the car coming with offerings like – projector headlamps and LED daytime running lights, new sporty allow wheels and an all-new styling. The cabin is also loaded with features like – touchscreen infotainment system with Apple CarPlay, Android Auto, and MirrorLink supports (only in the top-end ZXi+ and ZDi+ variants) along with several smart and impressive features in the lower variants. Passenger safety has been given a lot of importance as the car comes with dual airbags, ABS with EBD, brake assist and ISOFIX child seat mounts as standard across its trim levels.

Powertrain wise, the new Dzire remains unchanged, offering the same 1.2-litre K-Series petrol engine that makes 82 bhp and a 1.3-litre DDiS diesel developing 74 bhp. That said, in addition to the 5-speed manual gearbox, now both engines come mated to Maruti’s AMT unit – the Auto Gear Shift as an option. Fuel efficiency has also gone up with the petrol model returning 22 kmpl and the diesel version offering 28.48 kmpl.

All these are reasons enough to make the new Maruti Suzuki Dzire a worthy and value for money product. But with such growing demands customers will have to face a longer waiting period as well. And while at the launch of the car the company confirmed that there is already a waiting period of 8 weeks for the new-gen Dzire, we have come to know that now the waiting period has almost doubled.

Sauber F1 And Team Principal Monisha Kaltenborn Part Ways

Formula One team Sauber F1 and team principal Monisha Kaltenborn have parted ways with immediate effect. Kaltenborn has left her role as team principal and CEO at Sauber by mutual consent and over “diverging views”, a statement read from the team. The Indian-born Australian had been with the Hinwil based team since 2000 as the head of legal, and was promoted to the position of CEO in 2010. In October 2012, she became the first and only female team principal in F1 as well as a shareholder.

A brief statement from Pascal Picci, Chairman of Sauber Holding AG read, “Longbow Finance SA regrets to announce that, by mutual consent and due to diverging views of the future of the company, Monisha Kaltenborn will leave her positions with the Sauber Group effective immediately.”

“We thank her for many years of strong leadership, great passion for the Sauber F1 Team and wish her the very best for the future. Her successor will be announced shortly; in the meantime we wish the team the best of luck in Azerbaijan.”

Monisha Kaltenborn took the position of team principal from founder Peter Sauber in 2012 after his retirement, and continued in the role when the team was acquired in full by Longbow Finance S.A. in July last year. Under the Kaltenborn stewardship, Sauber finished seventh in the constructors’ standings in 2013, its best in the past years, having not done any better than eighth. The team finished tenth last year with just two points.

sauber f1 team

While neither parties have opened about the actual reason to part ways, it believed that the Sauber’s new owner’s desire to favour Marcus Ericsson over Pascal Wehrlein was not particularly appreciated by Kaltenborn, and is one of the issues that led to her departure from the team.

However, Pascal Picci has refuted the speculations that suggest Sauber’s drivers do not receive equal treatment. Picci said, “This is not only patently untrue, it would be contrary to the team’s absolute and longstanding commitment to fair competition. These reports, attributed to anonymous ‘sources’, are highly detrimental to both Marcus Ericsson and Pascal Wehrlein as well as to the management and all staff of the Sauber F1 Team.”

The Sauber F1 team have been part of the championship since 1993, changing several partners in the process, more notably BMW. The team was bought by the Swiss finance group last July, which helped secure the struggling team’s future in the sport.

At present, Sauber is ninth in the constructors’ standings with four points, ahead of McLaren which is struggling with reliability issues of its poor Honda engines. In fact, Sauber announced earlier this year that it will be switching to Honda engines next season switching from Ferrari customer engines.

American Products: Made in China

Eastern countries, mostly Asian countries, like the Philippines have always been amazed by the ingenuity of US products. If we walk through streets of Korea, Malaysia and other countries in the east, we will see at least 80 percent of the population are wearing or using US products. Although technologies developed in Japan and Singapore are already closely competing with the US brands, the mentality of people for products made in the US still has a different presentation. The consumer, most often, picks a product just simply because it is made in the US. However, not all US products are made in their own soil. Most of them are designed in the US but assembled in Asian countries, mostly China.

There are iconic brands such as Mattel, Inc., the maker of Barbie, which used to manufacture in the United States. However, the main concern of manufacturing in the US is the high cost of labor and expensive cost of goods. Mattel, Inc. Headquarters remain in California but it sends 65% of the manufacturing to China. China cost of labor is one of the cheapest in the world. Most manufacturing is outsourced to China because of this fact. They also have wide spaces to build manufacturing plants.

Aside from toy companies, clothing brands have also outsourced the manufacturing in the east. Levi’s Jeans and Converse Chuck Taylors are some of the brands. Levi’s Strauss has been one of the oldest companies manufacturing denim blue jeans. Their products are known to be durable and have been a symbol America through the years. Today, it has shifted its mass production in Southern American and Asia. Converse Chuck Taylors, famous by its short name “chucks”, were so popular back in the old days. In 1997, they sold the world-breaking record of 550 million pairs of shoes. However, the hype of the product was not sustained and a lot of competitors began the market similar products, the sales in declined causing the US factory’s shutdown. Now, they have shifted their production to Asia to reduce costs and sustain the company.

The most popular item on the list would be Apple products. Apple has brought a lot of innovation to technology. A number of people have found so much ease in their lives by using their iPhones, iPad and Mac Books. The technology was designed by Silicon Valley’s best engineers. Although it originates in California, Apple outsources 100 percent of its manufacturing and production in China. If you notice, it is written at the back of the products, “Designed by Apple in California, Assemble in China”. This shows that even the most popular brands think very practical. However, due to recent events, this mindset is slowly starting the shift back to how it was way back where production was done in the country.

In the whole of America, approximately 98 percent of shoes and apparel sold are produced overseas. Current Trump news states that the direction of the new government is to bring back manufacturing in the US. He has imposed a Big Border Tax for US Manufacturers wanting to move their production overseas. All shipments are taxed accordingly. However, there have been a lot of speculations that to start the regime, the leader must lead by example. Bashers have been highlighting that the Donald J. Trump Collection and even her daughter, Ivanka’s clothing line, to have entered the US without the said tax. Clearly, the slogan campaign “Made in America” has no strict implementation and corruption has still prevailed. It will still be a long transition before companies can completely move their production back to the US.

Expert witness testimony

When a trial is complex and needs clarification about scientific or technical details, lawyers tend to call in expert witnesses to explain these complex matters to a jury. The right expert witness testimony can win a trial and the wrong one can lead a jury down a road of confusion that potentially causes a ruling against the party the testimony was trying to help. Understanding what makes up a good expert witness before selection can pay huge dividends later on.

Image result for Expert witness testimony

Things To Consider During Selection

Certain factors in witness selection are true of all experts, while others tend to be more case-specific. Some standard factors to think about would be like does this person have the proper skills and knowledge relevant to the case. The expert’s education should be called into question along with any distinctive credentials like the proper licensing or board certifications. Other important factors of the witness’s background would involve their professional training and practice, plus  how much testifying experience they have had in the past.

After determining if the expert witness is qualified, next comes judging if they are the right fit for the trial. The witness may have the experience necessary to testify but are they able to convey that experience in the court of law. Not all teachers can teach, and not all experts can testify. A lawyer must make sure that this expert has the communication skills to relate to the jury and that their presentation style matches the way the case will be presented.

Lastly, make sure the witness knows how the trial will be played out and that they know their role during the deposition, discovery, and cross examination. Also, if it is a case involving corporations, make sure the witness does not work for a rival organization which would result in a conflict of interest during the trial.

Exercise Due Diligence

It is a lawyer’s responsibility to conduct the proper due diligence when selecting a witness. Check through a witness’s web pages and social media accounts. See if there are any negative aspects or opinions in the expert’s life that can have a bias on their testimony. Spending some time doing the necessary footwork to find out if a witness fits the case will play a significant factor as the trial reaches it conclusion. Having a case lost do to not researching the witness is a costly mistake for the lawyer and the client.

How to Use a Ladder With Maintenance Supplies Safely

The process of using a ladder safely while working with RF combiners and other electrical accessories isn’t always easy if the environment and the working conditions in a project area aren’t ideal. Although the conditions in various regions vary, there are simple ways to complete jobs while using a ladder during different situations in an effective and efficient manner.

General Strategies

Always begin a project by examining your conditions thoroughly. If you’re dizzy or weak, you shouldn’t climb the ladder because you may trip while moving up the rungs.

Wind speeds can dramatically impact balance while using a ladder, so you should never tackle wiring tasks when the weather is windy. If lighting is present during a wind storm, step away from the ladder if it’s made of metal, as aluminum attracts lighting strikes.

After a rainstorm, a ladder that’s constructed out of stainless steel or aluminum will be slick. In order to ensure the highest level of safety when climbing a damp ladder, always wear shoes with soles that don’t slip.

Professional Strategies

All ladders have a Duty Rating that determines toughest and safety. A highly reliable ladder should have a rating that’s higher than the weight of:

  • Electrical tools
  • Maintenance supplies
  • The climber

Easy Ways to Avoid Injuries

When climbing a ladder, posture is important because it reduces the risk of tumbling off rungs. The best way to prevent dangerous situations that involve improper posture is by wearing shoes with heavy soles since the extra weight will stop foot fatigue.

During jobs in dusty environments, traction can impact safety in a dramatic away. If someone tries to climb a ladder with dusty shoe soles, the process of staying on the rungs will be challenging. By cleaning your shoes thoroughly before using a ladder in a construction zone, you’ll maximize traction and prevent tumbling.

If you’re going to scale a ladder with a RF combiner and other electrical accessories, always use a tool belt. While everything is secured in the tool belt, you’ll less likely trip on the ladder because your hands will be free.

These ladder safety strategies benefit independent contractors and crews that tackle electrical tasks for big businesses. Proper ladder safety is vital because it impacts balance, performance, and efficiency.
